Horrible Court Decision in Virginia: Biker Death

    Hello Folks,

I do not post this link to incite full bodied anger (which I know some will feel, I did) but to reinforce the need for all of us to be ever vigilant.

The jest of this story from two years ago is, a local rider on a highway/road I ride at times, was hit from behind while he was at a stop waiting to turn. The Ford that hit him did not see him, nor did the driver even see the stop sign. He was found guilty of causing the death due to reckless driving, but today a three judge panel ruled the driver was not guilty as charged. I'll let you read the ruling if you are so inclined for the details which I do warn you are disturbing.

Here is the link to the court's finding. http://www.courts.state.va.us/opinio...wp/1595194.pdf

I know some of you are well versed in traffic law (1olbull) , I would like your take once you've read why the two judges ruled in favor of the killer.

Well, it doesn't seem to me that he was driving recklessly, he just didn't see him.

That seems to be the 2 judges thought as well. I am not sure why Mr. Nelson was not charged with Vehicular Manslaughter to begin with.
